Possible Penalty
Felony Battery: Probation, or 2, 3, or 4 years in prison
Assault with a deadly weapon: Probation, or 2, 3 or 4 years in prison
Assault and battery cases can result in lengthy prison terms and "Strikes" under California law if they are not handled properly. In addition to the above penalties, there are significant additional penalties for use of a firearm or infliction of serious bodily injury. To ensure that prosecutors do not aggressively "overcharge" your case, it is essential to retain an experienced lawyer for your protection.
